(the “Website”). To make the Website informative and useful, we ask that all the visitors to and subscribers (“users”) of the Website including users of the Pay-Per-View facility for delivering full-text articles adhere to our terms and conditions (“Terms”). Please check these Terms periodically for changes. By accessing and using the Website, you indicate your acknowledgement and acceptance of these Terms (including any changes).
This is a legally binding agreement.
Institutional Subscribers – Site License Agreement
1. Introduction
The Website is owned and operated by NTC Publications Ltd (NTC) – see para. 15 below for contact details. Subscribers to the printed journal World Economics are allowed free online access to the Website including free download of full-text articles subject to these Terms. Non-subscribers can purchase full-text articles in PDF form from the Website via a Pay-Per-View system and will be able to access a HTML version of the PDF for 1 week following purchase. NTC reserves the right to suspend or terminate your access and use of the Website at any time, and may exercise this right with or without notice.
2. Our Privacy Policy
NTC respects your privacy as a subscriber or visitor to the Website. We only gather personally identifiable data, such as names, addresses, e-mail addresses, etc. when voluntarily submitted by the visitor. NTC and its divisions, subsidiaries and associated companies may use this information for promotional purposes, unless you have opted out from receiving promotional mailings by contacting NTC (see para. 15 for contact details). We never impart email addresses to third parties without permission.
3. Restrictions On Use Of Materials
3.1
All material on the Website and messages by email belong to NTC. You may retrieve and display content from the Website on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk (but not on a server or any other storage device connected to a network except as expressly provided for in these Terms) for your personal, non-commercial use.
3.2
Except as expressly set out in 3.1, you may not reproduce, republish, post, transmit, upload, modify or in any way commercially exploit any of the Website’s content (as print or in electronic form). Information may be used as source material having given full credit to World Economics and NTC as the copyright owner. Modification of the materials at or downloaded from the Website or use of such materials for any purpose other than allowed under these Terms is a violation of NTC’s copyright and other proprietary rights.
3.3
The database of material contained on www.world-economics-journal.com may not be downloaded in its entirety, nor may any user create a database in electronic or structured manual form by systematically downloading and storing any or all of the content.
4. Institutional Subscribers
Institutional including Library subscribers who have a current subscription paid for at the Institutional rate to the print journal World Economics (such an Institutional subscriber hereinafter referred to as the “Licensee”) by accessing and using the Website agree to a Single Site License (a Single Site being a contiguous geographical location from which Authorised Users as defined below can access World Economics material online over a secure network) to access and use the Website subject to these Terms.
4.1
The Licensee may access and allow Authorised Users (as defined below) to access the full-text articles at www.world-economics.journal.com provided that such access is through a secure server whereby the Licensee can limit distribution of World Economics online materials at the Website to the Authorised Users who shall be informed by the Licensee of these Terms (available at the Website) with which all persons accessing the Website must comply.
4.2
Authorised Users are employees of the Licensee and students studying at the Licensee’s institution and visitors using with the Licensee’s permission terminals controlled by the Licensee, all at a Single Site as defined above.
4.3
The Licensee shall issue passwords or other access information only to Authorised Users and make all reasonable endeavours to prevent Authorised Users divulging their passwords or other access information to any third party.
4.4
The Single Site License shall automatically terminate on expiry of the Licensee’s current paid-for subscription period but shall continue automatically if the Licensee renews the subscription.
4.5
Enquiries regarding possible multi-site licenses should be directed to the Subscriptions Department at NTC (see para. 15 for contact details).
5. NTC Trademarks
Unless otherwise stated, all trademarks, service marks, and trade names are proprietary to NTC.
6. Trademark Notice
The Website may contain trademarks, copyrights and other intellectual property rights of third parties. All such rights are proprietary to their respective owners. Users are prohibited by law and these conditions from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any content on the Website for commercial or public purposes. Except as specifically permitted in accordance with the Terms and conditions governing use of the Website, any use of such trademarks or tradenames is strictly prohibited without the express written permission of these owners.
7. Disclaimer and Limitation Of Liability
7.1
The user/visitor expressly acknowledges and agrees that the Website is provided subject to the disclaimers and limitations of liability set out in these Terms & Conditions, and agrees to be bound by them.
7.2
NTC relies on the World Wide Web for the delivery of the Website to subscribers and without limiting the foregoing whilst NTC will use reasonable efforts to minimise delays and interruptions in the delivery and/or updating of the Website, NTC will not be liable to subscribers in any manner whatsoever for any consequences of such delay or interruption.
7.3
Every user who visits this Website does so at his or her own risk. The materials in the Website are provided 'as is' and without warranties of any kind either express or implied including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose, title, non-infringement, security or accuracy. NTC, nor any other party involved in the creation, production or delivery of the Website or whose materials or information appear in the Website, will not be liable for any damages or injury caused by, including but not limited to, any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus, line failure, technical inaccuracies, typographical errors or the inability to use the materials in the Website, even if there is negligence on NTC’s part or an authorised NTC representative has been advised of the possibility of such damages, or both.
7.4
NTC may discontinue the Website or any part immediately if the provider of the material contained on the Website, or any part, withdraws or limits the License or authority of NTC to include such material on the Website.
7.5
The above limitation or exclusion may not apply to you to the extent that applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages. In that event, NTC’s total liability to you for all losses, damages, and causes of action (in contract, tort, including without limitation, negligence, or otherwise) will not be greater than the amount you paid to access the Website.
8. Force Majeure
Failure or delay by NTC in performing its obligations under this Agreement as a result of circumstances outside NTC’s reasonable control shall not constitute a breach of this Agreement. NTC shall, as soon as conditions return to normal, take all reasonable steps to rectify the failure or delay at the earliest opportunity. Notwithstanding the foregoing, if such event of force majeure continues for more than thirty (30) days, the Licensee shall be entitled to terminate this Agreement.
9. Assignment
You may not assign, sub-license or otherwise transfer any of your rights or obligations under these Terms.
10. Invalidity
If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms, which remain in full force and effect. Headings in these Terms are for convenience only and will have no legal meaning or effect.
11. Links
11.1
NTC is not responsible and assumes no responsibility for the contents of any non-NTC linked Internet website, or for any potential damage arising out of or in connection with the use of any such link. The Internet websites to which links are provided in this Website are not under the control of NTC. Access to any other Internet sites linked to the Website is at the user's own risk.
11.2
In addition, the existence of a link between this Website and any other Internet website is not and shall not be understood to be an endorsement by NTC of any material, substance, information or the owner or proprietor of the linked Internet website, or of the site's privacy policies, and such link shall not imply nor create any relationship nor endorsement between NTC and the owner or proprietor of such linked website.
12. Termination
NTC may cancel or withdraw access to the Website and without notice at any time and may amend or terminate these Terms for any reason.
NTC reserves the right to block access from any user who is making downloads from the Website in a manner that NTC deems to be unauthorised or suspicious. This includes: individual users downloading more than 50 articles within one week, users making sequential downloads from an index category and users who do not complete a registration form or complete it with false details.
13. Jurisdiction and Validity
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, regardless of where the user is based. You agree that any action at law or in equity arising out of or relating to these Terms shall be filed only in the United Kingdom, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
14. Pay-Per-View
The purchase of a full-text article provides access to the information via PDF or HTML. The PDF of the article and the link to the HTML version will be sent to the purchaser’s email address as provided in their invoice details, once the purchase transaction is completed. The link to the HTML version will be active for 1 week following the purchase of the PDF.
The purchaser may not share the PDF with any person(s) located at different sites or offices, unless permission is requested in writing and agreed by NTC. Purchase is by credit/debit card only, and a maximum of 25 articles may be purchased on any single credit/debit card transaction.
